Emily Meeker is an experienced litigator who represents clients in government-related disputes, condemnation cases, land-use matters, and other complex civil litigation.

Emily joined Poyner Spruill after more than six years as a trial attorney at the U.S. Department of Justice with the Attorney General’s Honors Program. At the Department of Justice, she served as lead counsel in a wide range of significant cases, from takings cases to tort lawsuits to environmental disputes. This experience included multiple trials. For her work on these cases, Emily was awarded the Department’s Outstanding Performance Rating three times.

In addition to her focus on trial work, a substantial portion of Emily’s practice is also devoted to appeals. Before joining the Department of Justice, Emily clerked for Judge Walter K. Stapleton of the U.S. Court of Appeals for the Third Circuit. Before clerking on the Third Circuit, she clerked for Judge Leonie M. Brinkema of the U.S. District Court for the Eastern District of Virginia. She also interned for U.S. Supreme Court Justice Sonia Sotomayor when Justice Sotomayor served on the U.S. Court of Appeals for the Second Circuit.

Representative Experience

  • Emily currently represents the plaintiffs in Craft Freedom v. North Carolina, a constitutional challenge to confiscatory state laws that force craft breweries to hand over their self-distribution businesses, distribution rights, brand control, and future profits to private distributors.
  • Emily currently represents the plaintiff in a whistleblower lawsuit against two district attorneys and other state officials. The lawsuit details how the plaintiff, a 20-year judicial branch employee, was fired in retaliation for reporting the district attorneys to the State Bureau of Investigation. In the wake of the lawsuit, both district attorneys resigned and were indicted.
  • Emily currently represents the world's largest seller of tobacco seed in eight North Carolina Business Court cases involving multi-million dollar breach-of-warranty claims.
  • At the Department of Justice, Emily served as lead counsel in an inverse condemnation case involving the High Line, a prominent park and greenway in the heart of New York City. She successfully opposed class certification and obtained summary judgment for the defense on all claims. Emily also presented oral argument before the U.S. Court of Appeals for the Federal Circuit, helping to preserve the trial court’s favorable summary judgment ruling.
  • At the Department of Justice, Emily was lead counsel in a multi-million dollar takings claim involving actions by the U.S. Navy and Department of the Interior on Culebra, an island in Puerto Rico. After conducting fact and expert discovery, Emily appeared as lead counsel at trial and secured a favorable result.
  • At the Department of Justice, Emily was lead counsel in a regulatory takings case involving mangrove wetlands. After conducting full discovery, she obtained a favorable settlement for the United States at mediation.
